In consideration of receiving a from at Diabolik Tattoo and Piercing together with its contractors and owners, I agree to the following;
1. That l, have been fully informed of the inherent risks associated with getting a tattoo/piercing. I fully understand that these risks, known and unknown can lead to injury, including but not limited to, infection, scarring, difficulties in detecting melanoma and allergic reaction to tattoo pigment, latex gloves and/or soap. Having been informed of potential risks associated with getting a tattoo/piercing, I still wish to proceed with the tattoo/piercing application and freely accept and expressly assume any and all risks that may arise from the tattoo/piercing.
2. TO WAIVE AND RELEASE, to the fullest extent permitted by law, each of the artist(s) and shop owners including all claims or causes of action that l, my estate, heirs, executors or assigns may have for personal injury or otherwise, including any direct and/or consequential damages, which result or arise from the application of my tattoo/piercing, whether caused by the negligence or fault of either the artists and/or Diabolik Tattoo and Piercing or otherwise.
3. The artist/piercer has given me the full opportunity to ask any and all questions about the application of my tattoo/piercing and all of the questions have been answered to my total satisfaction.
4. The artist/piercer has given me instructions on the care of my tattoo/piercing while it is healing, and I understand them, and will follow them. I acknowledge that it is possible that the tattoo/piercing can become infected, particularly if I do not follow the instructions given to me. If touch-up work to the tattoo is required due to my own negligence, I agree that the work will be done at my own expense.
5. I am not under the influence of drugs or alcohol, and am voluntarily submitting to being tattooed/pierced by the artist/piercer without duress or concern.
6. A tattoo is a permanent change to my appearance and can only be removed by laser or surgical means, which possibly can be disfiguring and/or costly and which, in all likelihood, will not result in the restoration of my skin to its exact appearance prior to being tattooed.
a. I have truthfully informed the artist in regards to any blood-borne illness of which I am suffering.
b. I do not have diabetes, epilepsy, haemophilia, a heart condition, nor do I take blood thinning/anticoagulant medication.
c. I do not have any other medical or skin condition that may interfere with the application or healing of the tattoo/piercing.
d. I am not the recipient of an organ or bone marrow transplant, or, if I am I have taken the prescribed regimen of antibiotics that is required by my doctor in advance of an invasive procedure such as tattooing or piercing.
e. I am not pregnant or nursing.
f. I do not have a mental impairment that may affect my judgment in getting the tattoo/piercing.
7. Neither the artist, nor the shop owner is responsible for the meaning or spelling of the text that I have provided to them.
8. Variation in color and design may exist between the tattoo art have selected and the actual tattoo when it is applied on my body. I also understand that over time the colors and clarity of the tattoo will fade due to unprotected exposure to the sun and the naturally occurring dispersion of pigment in my skin.
9. I release all rights to any photographs taken of me and the tattoo, and give consent to their reproduction in print or electronic form for use by the artist/studio.
10. I agree to reimburse the artist/shop owner for any legal fees and costs incurred due to any legal action I bring against either the artist or the shop owner. I agree that the courts of Newcastle, New South Wales in Australia shall have personal jurisdiction and venue over me and shall have jurisdiction for the purpose of litigating any dispute arising out of, or relating to this agreement.
11. I acknowledge I have been given adequate opportunity to read and understand this document and I understand that I am signing a legal contract waiving certain rights to recover against the artist and/or shop owner. I further acknowledge that I was offered the opportunity to obtain legal advice in relation to this agreement.
If any provision, section, subsection, clause or phrase of this release is found to be unenforceable or invalid, that part shall be severed from this contract. The remainder of this contract will then be construed as though the unenforceable portion had never been contained in this document.
"I hereby declare that I am of legal age (18 years of age or older for a tattoo, 16 years of age or older for a piercing and have valid proof of age if required) and am competent to sign this agreement."
